Terms of Service – Nozza’s Tips

These Terms of Service govern your use of the Nozza’s Tips website and services. By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not accept these Terms, you must not access or use our Service.

1. About Us

1.1 Service Provider: Nozza’s Tips is an online tipping service operated in South Australia.
1.2 Nature of Services: We provide users with sports betting tips. The Service is for entertainment purposes only and is not a financial product or service.

2. Eligibility and Access

2.1 You must be at least 18 years of age or the legal age of majority in your jurisdiction to use our Service.
2.2 You represent and warrant that you are legally permitted to access and use the Service under the laws of your country or region.
2.3 If you access the Service on behalf of an entity, you warrant that you are authorized to agree to these Terms on its behalf.

3. User Accounts

3.1 Registration: To access certain features, you may need to register for an account by providing accurate and complete information.
3.2 Account Security: You are solely responsible for maintaining the confidentiality of your login credentials and all activity under your account.
3.3 Misuse: We reserve the right to suspend or terminate accounts that are:

Used for fraudulent or abusive purposes;
Sharing tips or content with third parties;
Violating these Terms in any other way.

4. Payments and Billing

4.1 Payment Provider: All payments are processed securely via Stripe, our third-party payment processor.
4.2 Pricing: Fees for our services are clearly stated on the site and may be updated periodically. All amounts are in Australian Dollars (AUD) unless stated otherwise.
4.3 Subscriptions: If you purchase a recurring subscription:

Your payment method will be charged at regular intervals (e.g., monthly) until you cancel.
You may cancel your subscription at any time via your account settings.
Cancellations apply to future billing cycles only.
4.4 Failed Payments: If a payment fails, access to premium content may be suspended until the issue is resolved.
4.5 Subscription Pauses During International Breaks:
During international breaks—periods when no Premier League matches are scheduled—subscriptions to the Premier League Service will be automatically paused for one week, corresponding to the missed Premier League match weekend. During this pause, subscribers will not receive tips nor be charged. Subscription billing and tip delivery will resume the following week when regular Premier League fixtures recommence. This pause applies only to the Premier League Service.

5. Refund Policy

5.1. Due to the digital nature of our content, all sales are final unless a refund is explicitly offered for a specific product or package.

5.2 Refunds are generally not provided, including for:

Dissatisfaction with tip performance;
Missed or unused tips;
Incorrect user expectations.

5.3 In rare circumstances (e.g. accidental double charges), you may request a refund by contacting us. Refund decisions are at our sole discretion.

5.4 Refund Guarantees – 2025/26 Season Packages
Refund guarantees apply only to users who purchase a full season package for the 2025/26 season. The applicable guarantees are:

For the Premier League Service, if a minimum profit of 30 units is not achieved during the 2025/26 Premier League season, a full refund will be issued at the end of the season.
For the Premium Service, if a minimum profit of 100 units is not achieved across all competitions covered during the 2025/26 season, a full refund will be issued at the end of the season.

These guarantees apply only to the 2025/26 season packages and do not extend to monthly subscriptions, weekly subscriptions, one-off purchases, or other service tiers. This offer expires once the 2025/26 season commences. However, this clause will remain active for eligible users who purchased a season package before that time.
5.5 All performance and profit tracking is based on the official odds available at the time tips are released. Due to market movement, subscriber odds may differ depending on how quickly the tip is followed and what bookmakers are used. We are not responsible for any variance in odds or availability. Refund guarantees (see 5.4) are based solely on official recorded results, not individual subscriber performance.

6. Service Availability and Modifications

6.1 We aim to provide uninterrupted access but do not guarantee uptime or availability.
6.2 We reserve the right to modify, suspend, or discontinue parts or all of the Service at any time, with or without notice.
6.3 We are not liable for any loss or inconvenience caused by service interruptions.

7. Disclaimer and Risk Notice

7.1 Nozza’s Tips provides tips for entertainment purposes only.
7.2 No Guarantee of Results: Past performance of tips does not guarantee future success.
7.3 No Financial Advice: We do not offer financial, investment, or gambling advice.
7.4 You acknowledge and accept all risk associated with using our tips, including financial loss. You use the Service at your own risk.
7.5 If you gamble based on our tips, you do so entirely at your own discretion and must do so responsibly and legally in your jurisdiction.

8. Acceptable Use and Conduct

8.1 You agree to use the Service for lawful purposes and in accordance with these Terms.
8.2 Prohibited activities include, but are not limited to:

Sharing, reselling, or publishing our tips or premium content;
Using bots or automated systems to access or scrape our data;
Engaging in abusive, harassing, or deceptive behavior;
Attempting to hack, disrupt, or reverse-engineer the site.
8.3 We reserve the right to suspend or terminate access for users who violate these provisions.

9. Intellectual Property

9.1 All content on the Service—including tips, text, logos, graphics, and design—is the intellectual property of Nozza’s Tips.
9.2 You may not reproduce, distribute, or create derivative works from our content without prior written permission.
9.3 Unauthorized use of our intellectual property may result in legal action.

10. Limitation of Liability

10.1 To the fullest extent permitted by law, Nozza’s Tips and its operators shall not be liable for any:

Loss of money, profit, data, or opportunity;
Personal injury, emotional distress, or indirect damages;
Technical issues including service interruptions or payment processing errors.
10.2 You acknowledge that tipping services carry inherent uncertainty and financial risk, and you release us from liability related to your use of the Service.

11. Indemnification

11.1 You agree to indemnify and hold harmless Nozza’s Tips, its directors, employees, and partners from any claims, losses, damages, or liabilities arising from:

Your breach of these Terms;
Your misuse of the Service;
Your violation of any applicable laws or rights of third parties.

12. Privacy

12.1 We value your privacy. Our data practices are governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.
12.2 By using the Service, you consent to our data handling as described in the Privacy Policy.

13. Termination

13.1 We may terminate or restrict your access to the Service at any time if you violate these Terms or for any other reason at our sole discretion.
13.2 Upon termination, all rights granted to you under these Terms will cease immediately.

14. Governing Law and Jurisdiction

14.1 These Terms are governed by the laws of South Australia, Australia.
14.2 Any disputes arising from or relating to these Terms will be subject to the exclusive jurisdiction of the courts of South Australia.

15.2 If we make material changes, we will notify users via email or on our website. Continued use of the Service after such changes constitutes acceptance of the new Terms.
